A Sonora-based doughnut shop has been named in a lawsuit filed by a Mark Twain St. Joseph's Hospital administrator injured in a June accident caused by a 15-year-old driver employed by the business.
According to the lawsuit, the teen, Aaron Van Winkle was killed in the accident but Larry Cornish, spokesman and facilities vice president for the San Andreas hospital, sustained a broken right foot and broken right collar bone. The head-on collision was supposedly caused by the teen only two weeks after his birthday.
The recent lawsuit comes on the heels of the lawsuit filed by the boy's parents against the doughnut shop.
The Donut Factory was also named in a wrongful-death lawsuit filed by the boy's parents. The boy did not have a license at the time that he was making a delivery for the doughnut shop and caused the crash on June 24th.
Cornish are seeking an unspecified amount in monetary damages from the company. Cornish and his attorney claim that the store owner was aware that they boy did not have a license when he asked him to make the delivery.
Another claim in the lawsuit is that the Donut Factory reported the car stolen a little after the accident occurred.
A report from the California Highway Patrol confirmed that somebody from the Donut Factory tried to claim that the car had been stolen four days after the incident had even occurred. The claim was denied after witnesses supported that the car had in fact not been stolen.
Cornish were headed west when he collided with Van Winkle's car, which was headed east. Cornish have since then complained of physical as well as emotional injuries which have affected his life deeply.
Criminal charges have not been filed despite the filing of two civil lawsuits in connection with the accident. According to authorities, there is not enough evidence showing that the owner did not know that the boy was unlicensed to merit filing criminal charges against the business.
Prosecutors had considered pressing charges against the Donut Factory for child endangerment and permitting an unlicensed driver to drive but those were dismissed.
